Foam Terms of Service

Welcome to Foam, a platform operated by Song Athletics Ltd ("Song Athletics", "Foam", "we", "us" or "our"). These Terms of Service ("Terms") govern your access to and use of Foam, including our website, applications and services (collectively, the "Platform"). By creating an account or using the Platform, you agree to these Terms.
1. Who We Are

2. Related Agreements
These Terms form the master agreement governing your use of Foam. Depending on how you use the Platform, additional agreements also apply:
- End User Licence Agreement (EULA) — applies whenever you browse, download or use Content made available through Foam.
- Creator Upload Agreement — applies whenever you upload or publish Content through Foam.
- Privacy Policy — explains how we collect and use personal information.
- Cookie Policy — explains our use of cookies and similar technologies.
By using the Platform, you agree to comply with all agreements applicable to your use.
3. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. If you are under that age, you may only use the Platform with the permission and supervision of a parent or legal guardian. By using Foam, you represent that you have the legal capacity to enter into these Terms.
4. Your Account
You are responsible for maintaining the security of your account and password. You agree to:
- provide accurate registration information;
- keep your account details up to date;
- keep your login credentials confidential;
- notify us promptly if you believe your account has been compromised.
You are responsible for all activity occurring under your account.
5. Acceptable Use
You agree not to:
- use Foam for any unlawful purpose;
- interfere with the operation or security of the Platform;
- attempt to gain unauthorised access to accounts or systems;
- upload malicious software or harmful code;
- scrape or harvest Platform data without our written permission;
- misuse any Content in breach of the EULA;
- upload Content in breach of the Creator Upload Agreement.
6. Intellectual Property
The Platform, including its software, branding, logos, design, text and other materials (excluding Creator Content), is owned by or licensed to Song Athletics Ltd and is protected by intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.
7. User Content
Creators retain ownership of the Content they upload. Users receive only the licence granted under the End User Licence Agreement. Song Athletics does not claim ownership of Creator Content.
8. Platform Availability
We aim to keep Foam available and reliable but do not guarantee uninterrupted access. We may update the Platform, modify features, suspend services, remove Content, carry out maintenance, or discontinue features, at any time and without prior notice where reasonably necessary.
9. Suspension and Termination
We may suspend or terminate your account where we reasonably believe you have breached these Terms, the EULA, or the Creator Upload Agreement, infringed third-party rights, or created legal or security risks for the Platform. Termination does not affect licences already granted under the EULA.
10. Third-Party Services
Foam may contain links to third-party websites or services. We are not responsible for their content, availability or privacy practices. Your use of third-party services is governed by their own terms.
11. Disclaimer
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Song Athletics Ltd disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted availability.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Song Athletics Ltd shall not be liable for any indirect, incidental, consequential or special damages arising from your use of the Platform. Nothing in these Terms excludes liability that cannot lawfully be excluded under the laws of England and Wales.
13. Changes to these Terms
We may update these Terms from time to time. Where changes are material, we will take reasonable steps to notify Users through the Platform or by email. Continued use of Foam after the updated Terms become effective constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over disputes arising from these Terms.
